Mueller Indictments For Lying To FBI Are Unconstitutional, Fifth Amendment Being Torched

by Rick Wells

The FBI, DOJ and judiciary are not above the law and are subject to the Constitution, including the 5th Amendment, which they are trampling in their desperation to “Get Trump.”…

fbi mueller unconstitutional

With Robert Mueller’s continued egg hunt gathering incidental, inconsequential pleas and indictments for non-serious, non-collusion related crimes, including process crimes of lying to the FBI, a question does need to be answered for strict constructionists reading the plain English of the Constitution and Bill of Rights. While there are surely many legal scholars who would disagree, the language of the Constitution is very clear and doesn’t require a law degree to comprehend. The Fifth Amendment provides that:

“No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a Grand Jury, except in cases arising in the land or naval forces, or in the Militia, when in actual service in time of War or public danger; nor shall any person be subject for the same offence to be twice put in jeopardy of life or limb; nor shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use, without just compensation.”

That protection, “nor shall be compelled in any criminal case to be awitness against himself,” does not say in a criminal trial or in court or Congressional testimony, it says a criminal case. Criminal investigations are a huge component of a criminal case and compelling people to be witnesses against themselves are a daily occurrence.

The Mueller indictment of Tuesday against a Russian attorney, while a foreign national not directly covered by the Bill of Rights and the Constitution, is an incident of entrapment and disregard for the constitution of the same manner by the FBI as was used against American citizen and patriot, General Michael Flynn. The “lies” of omission or contradiction or the failure to confess all to an FBI agent, often a person of reprehensible moral character, as if he is a priest, is enough to ruin these men and any other American in the wrong situation for life.

The Russian indicted today, “Alex van der Zwaan, was indicted for lying to the special counsel about work he did back in 2016. In other words, he refused to be a witness against himself and now the dictator Mueller and his FBI henchmen are threatening to throw him in jail.

According to Politico, van der Zwaan is being charged on grounds that he “deleted and did not otherwise produce emails sought by the Special Counsel’s Office.” So he basically did the same thing Hillary Clinton got away with over 33,000 times on her emails alone, not to mention her other espionage crimes, profiteering, treason and racketeering. The Russians, Flynn, Manafort and Papadopoulis have the disadvantage of being useful to the Shadow Government in their efforts to remain in power. Clinton had the benefit of being one of the shadow government leadership, immune from prosecution by their puppets in the judiciary and law “enforcement.”

Clinton’s much more serious and damaging offenses, including lying to the FBI as well as innumerable “lies of omission,” are all being ignored by the same cabal of crooked establishment politicians who are railroading President Trump, General Flynn, Paul Manafort, George Papadopoulos and the “new guy,” Alex van der Zwaan.

Clearly the problems with our judicial system go well beyond merely the widespread corruption within the staff of the DOJ and FBI. The system, statutes, courts and processes are not imposed evenly and even where they may be are unconstitutional in their application.

If someone wants to lie to the FBI they should be able to do so. That is their right under the Constitution. If they don’t want to answer a question or provide information during an investigation, they shouldn’t have to. The federal government is operating outside of the law in its enforcement. We’ve been conditioned to just accept it and be “glad it isn’t me.”

That’s not right, it’s unconstitutional, it’s un-American and now that it’s being used to overthrow our President, it needs to become an major issue. Perhaps it will, if Congress has any testosterone left in their ovaries or if there are five honest men left on the Supreme Court. Every day presents the American people with more evidence that it’s going to take extraordinary measures to right the ship.
