Germany Admits It’s Unlikely To Arrest Netanyahu On ICC Warrant

But the reaction in Europe has been mixed. While all 27 member states of the EU are part of the ICC, Hungary has been most vocal in rejecting the warrants and The Hague court’s ruling, while Germany has said it is “examining” how to respond while signaling it’s unlikely to enforce it if PM Netanyahu visits the country.

Germany’s Foreign Minister Annalena Baerbock said on Friday, “We are now of course examining exactly what that means for implementation in Germany.” According to more:

Whether German authorities would move to arrest Netanyahu or former Israeli defence minister Yoav Gallant, who also had a warrant issued against him, is currently “theoretical”, Baerbock said.

Germany is “bound by” the court as a country which recognizes the body and respects international law, she said.

Clearly this has put Berlin, a staunch supporter of Israel, in an awkward position. This was acknowledged when government spokesperson Steffen Hebestreit was pressed by reporters over whether Germany authorities would actually carry out an arrest on the Israeli prime minister.

Several Western states have pledged to execute an arrest warrant for Israeli Prime Minister Benjamin Netanyahu issued by the International Criminal Court (ICC).

The Hague-based court on Thursday issued arrest warrants for Netanyahu along with former Israeli Defense Minister Yoav Gallant and Hamas commander Ibrahim al-Masri. West Jerusalem claims that al-Masri is already dead. The warrants are for alleged war crimes and crimes against humanity linked to the Gaza conflict.

The decision has elicited mixed reactions in the West. Several nations emphasized their respect for the independence of the court, while others voiced support for Israel.

The Netherlands, Switzerland, Ireland, Italy, Sweden, Belgium, and Norway all claimed they would meet their commitments and obligations under the Rome Statute and international law. However, Italian Defense Minister Guido Crosetto stressed that the ICC was “wrong” to put Netanyahu and Gallant on the same level as Hamas. Austria also said that it would obey the decision, but its foreign minister, Alexander Schallenberg, added that the warrant was “utterly incomprehensible.” (ER: Schallenberg is probably 2.0. A Soros puppet, he was installed briefly after Sebastian Kurz stepped down.)

Dutch Foreign Minister Caspar Veldkamp assured the country’s parliament that the authorities would act on the warrants and avoid non-essential contacts with those named.

Geert Wilders, the head of the Netherlands’ Party for Freedom, a member of the ruling coalition, condemned the decision, saying that the Israeli authorities are being confronted with arrest warrants instead of receiving international understanding and support.

Earlier this month, the Dutch capital saw rioting between Israeli soccer fans, who chanted anti-Palestinian slogans, and pro-Palestinian locals.

In France, Foreign Ministry spokesman Christophe Lemoine said that potentially acting on the warrants was a “complex legal issue” while admitting the importance of acting in line with ICC statutes. At the same time, Lemoine declined to say whether France would arrest Netanyahu or Gallant if they came to the country.

Meanwhile, Hungarian Prime Minister Viktor Orban denounced the ICC’s decision, telling a state radio station that he would invite the Israeli leader to Hungary. (ER: The plot thickens.)

Hungarian Prime Minister Viktor Orban has invited his Israeli counterpart Benjamin Netanyahu to visit Hungary despite the International Criminal Court (ICC) issuing a warrant for his arrest earlier this week.

In an interview with state radio on Friday, Orban, whose country holds the rotating EU presidency, condemned the ICC’s decision to demand the arrest of the Israeli leader and stated that his country would not execute the warrant.

“Today I will invite Israel’s prime minister, Mr Netanyahu, for a visit to Hungary and in that invitation, I will guarantee him that if he comes, the ICC ruling will have no effect in Hungary, and we will not follow its contents,” Orban said.

The Hague-based court has accused Netanyahu and former Israeli defense minister Yoav Gallant of war crimes and crimes against humanity amid the Jewish state’s ongoing operation against Hamas in Gaza. The warrant was issued by the ICC’s chief prosecutor, Karim Khan, who has also pressed similar charges against Hamas military leader Mohammed Deif.

The ICC’s move has been strongly condemned by Israel and the US.

A spokesman for the US National Security Council has claimed that the ICC “does not have jurisdiction over this matter,” and that Washington “fundamentally rejects the court’s decision.” He expressed concern at the prosecutor’s “rush to seek arrest warrants and the troubling process errors that led to this decision.”

Senior Israeli officials have accused the ICC of anti-Semitism over the arrest warrant. The country’s president Isaac Herzog has called the decision “outrageous” and claimed that it “makes a mockery of the sacrifice of all those who fight for justice – from the Allied victory over the Nazis till today.”

While Israel is not a signatory of the Rome Statute, which gives the ICC its power, the court has jurisdiction over the West Bank and Gaza, which are considered occupied Palestinian territories under international law.

The court’s jurisdiction is currently recognized by 123 countries, and Netanyahu and Gallant could face arrest if they travel to any of those nations.

The EU has said it would honor the ICC’s decision regarding the Israeli officials, with the bloc’s foreign policy chief Josep Borrell describing the court’s warrants as non-political, and calling on member states to respect and implement them.

Several EU states, including the Netherlands, France, Italy, Sweden and Norway, have also made statements supporting the ICC. Dutch Foreign Minister Caspar Veldkamp has vowed to fully comply with the court’s decision and act on the arrest warrants. The French Foreign Ministry has also said the warrants were “in line with ICC statues” but acknowledged that arresting Netanyahu would be “legally complex.”

  1. Trump respects strong leaders. This is entirely leftwing politically driven speculation. Netanyahu is entirely safe with Trump. If those American hostages aren’t released before trump takes office, expect to see American jets bombing Gaza until they do.
