Dutch parliament votes for Wilders ‘strictest asylum law ever’

Despite criticism from NGOs and lawyers, the Second Chamber in The Hague is voting for a significant tightening of asylum law. The PVV prevails – but there is a threat of resistance in the First Chamber. The final decision will be made in the fall.

The Dutch Parliament has approved a significant tightening of asylum law.

The majority of the Second Chamber adopted two highly controversial legislative proposals. This should make it much more difficult to get asylum in the Netherlands and bring family members with you. Staying in the country without valid papers as well as helping people without papers should become a criminal offense.

Lawyers, government advisors, asylum authorities and refugee organizations had warned against the introduction of the laws. The measures are legally dubious and practically impossible to implement.

The initiator of the tightening was the opponent of Islam, Geert Wilders. He took part in a government for the first time with his Party for Freedom (PVV) and wanted to enforce the ‘strictest asylum law of all time“. But in June the coalition collapsed over the asylum laws. New elections are planned for the end of October.

The PVV, the strongest force in the Second Chamber of Parliament, now voted for the proposed legislation together with its former government partners. Nevertheless, it is questionable whether the laws will also receive a majority in the First Chamber of Parliament, comparable to the Federal Council. The legislative package is expected to be dealt with there in the autumn.

50 percent fewer asylum seekers

In future, there should be two types of asylum status: refugees from war-torn or disaster-stricken areas, and people who are persecuted for individual reasons – such as ethnic origin –. The residence permit is to be shortened from five to three years and family reunification is also to be drastically restricted.

About 12 percent of migrants who come to the Netherlands annually are asylum seekers, and in 2024 there were 32,000 asylum seekers and around 10,000 relatives traveling after them. In the first three months of 2025, however, the numbers fell drastically by 50 percent. Similar trends exist in other European countries.
