Why I filed an International Criminal Court Complaint for Crimes against Humanity against the NM Gov’nor, et. al

Introduction:

The time for words is over. The time for writing is over. The time for “Roundtables” is over. The time for Senate Hearings is over. The time for petitions to our “government” is over. The time for Action is here.

There comes a time in a man’s life where more words become insufficient to quench his desire for movement. When words become superfluous. Words become worn out and broken tools, that have been overused.

Writing words that are never read. Roundtables turn into Spring Break-like orgies of “more studies are needed”. The results were inconclusive. We need to study this further, but first we need to apply for more “government” grant money [provided by the slave taxpayers.]

The time for posturing by the politico whores in bi-partisan Senate Hearings, with their fancy titles, of Chairman, Your Honor, Your Highness, Your Lowness, Ralph Nader, is over.

The time for petitions to our politico whore “government” who are bought and paid for by Lobbyists months and years in advance is over.

This is the strongest action I can take short of picking up armas and engaging in Revolution. So thus I engaged in this endeavor. No excuses, no apologies, just pick up the cudgel. In every act of defiance we reclaim our manhood, we reclaim our Humanity.

COMPLAINT FOR CRIMES AGAINST HUMANITY

AND ACTS OF AGGRESSION

The ICC has jurisdiction to accept this Complaint under Article 5 of the ICC:

Crimes within the Jurisdiction of the Court.

The Primary Plaintiffs in this complaint are Ricardo S. Giron, Sui Juris, Private Citizen, The Liberty Beacon Project, ex rel, The People of New Mexico and the United States Population, and the Defendants are the Governor of New Mexico, Michelle Lujan-Grisham and NM Health Secretary, Kathyleen “Kathy” Kunkel, Dr. David Scrase, NM Human Services Department Secretary, Louie A. Trujillo, Mayor of City of Las Vegas, NM, Anthony S. Fauci, NIAID Director, in their lawful and personal capacity.

The jurisdiction of the Court shall be limited to the most serious crimes of concern to the international community as a whole. The Court has jurisdiction in accordance with this Statute with respect to the following crimes:

    • The crime of genocide
    • Crimes against humanity
    • War crimes
    • The crime of aggression.

This Complaint falls under Article 7, Crimes against Humanity, paragraph 1, subsection 5, Imprisonment; subsection 6, Torture; subsection 11, Other Inhumane acts; and Article 8, Crime of Aggression.

Article 7 – Crimes against humanity

1) For the purpose of this Statute, “crime against humanity” means any of the following acts when committed as part of a widespread or systematic attack directed against any civilian population, with knowledge of the attack:

    • Murder
    • Extermination
    • Enslavement
    • Deportation or forcible transfer of population
    • Imprisonment or other severe deprivation of physical liberty in violation of fundamental rules of international law
    • Torture
    • Rape, sexual slavery, enforced prostitution, forced pregnancy, enforced sterilization, or any other form of sexual violence of comparable gravity
    • Persecution against any identifiable group or collectivity on political, racial, national, ethnic, cultural, religious, gender as defined in paragraph 3, or other grounds that are universally recognized as impermissible under international law, in connection with any act referred to in this paragraph or any crime within the jurisdiction of the Court
    • Enforced disappearance of persons
    • The crime of apartheid
    • Other inhumane acts of a similar character intentionally causing great suffering, or serious injury to body or to mental or physical health.

2) For the purpose of paragraph 1:

    • “Attack directed against any civilian population” means a course of conduct involving the multiple commission of acts referred to in paragraph 1 against any civilian population, pursuant to or in furtherance of a State or organizational policy to commit such attack
    • “Extermination” includes the intentional infliction of conditions of life, inter alia the deprivation of access to food and medicine, calculated to bring about the destruction of part of a population
    • “Enslavement” means the exercise of any or all of the powers attaching to the right of ownership over a person and includes the exercise of such power in the course of trafficking in persons, in particular women and children
    • “Deportation or forcible transfer of population” means forced displacement of the persons concerned by expulsion or other coercive acts from the area in which they are lawfully present, without grounds permitted under international law
    • “Torture” means the intentional infliction of severe pain or suffering, whether physical or mental, upon a person in the custody or under the control of the accused; except that torture shall not include pain or suffering arising only from, inherent in or incidental to, lawful sanctions
    • “Forced pregnancy” means the unlawful confinement of a woman forcibly made pregnant, with the intent of affecting the ethnic composition of any population or carrying out other grave violations of international law. This definition shall not in any way be interpreted as affecting national laws relating to pregnancy;
    • “Persecution” means the intentional and severe deprivation of fundamental rights contrary to international law by reason of the identity of the group or collective
    • “The crime of apartheid” means inhumane acts of a character similar to those referred to in paragraph 1, committed in the context of an institutionalized regime of systematic oppression and domination by one racial group over any other racial group or groups and committed with the intention of maintaining that regime
    • “Enforced disappearance of persons” means the arrest, detention or abduction of persons by, or with the authorization, support or acquiescence of, a State or a political organization, followed by a refusal to acknowledge that deprivation of freedom or to give information on the fate or whereabouts of those persons, with the intention of removing them from the protection of the law for a prolonged period of time.

3) For the purpose of this Statute, it is understood that the term “gender” refers to the two sexes, male and female, within the context of society. The term “gender” does not indicate any meaning different from the above.

Article 8: Crime of aggression

1) For the purpose of this Statute, “crime of aggression” means the planning, preparation, initiation or execution, by a person in a position effectively to exercise control over or to direct the political or military action of a State, of an act of aggression which, by its character, gravity and scale, constitutes a manifest violation of the Charter of the United Nations.

2) For the purpose of paragraph 1, “act of aggression” means the use of armed force by a State against the sovereignty, territorial integrity or political independence of another State, or in any other manner inconsistent with the Charter of the United Nations. Any of the following acts, regardless of a declaration of war, shall, in accordance with United Nations General Assembly resolution 3314 (XXIX) of 14 December 1974, qualify as an act of aggression:

    • The invasion or attack by the armed forces of a State of the territory of another State, or any military occupation, however temporary, resulting from such invasion or attack, or any annexation by the use of force of the territory of another State or part thereof;
    • Bombardment by the armed forces of a State against the territory of another State or the use of any weapons by a State against the territory of another State;
    • The blockade of the ports or coasts of a State by the armed forces of another State;
    • An attack by the armed forces of a State on the land, sea or air forces, or marine and air fleets of another State;
    • The use of armed forces of one State which are within the territory of another State with the agreement of the receiving State, in contravention of the conditions provided for in the agreement or any extension of their presence in such territory beyond the termination of the agreement;
    • The action of a State in allowing its territory, which it has placed at the disposal of another State, to be used by that other State for perpetrating an act of aggression against a third State;
    • The sending by or on behalf of a State of armed bands, groups, irregulars or mercenaries, which carry out acts of armed force against another State of such gravity as to amount to the acts listed above, or its substantial involvement therein.

Governor Michelle Lujan-Grisham has issued Executive Order 2020-004, issued on March 11th, 2020, requiring the People of the State of New Mexico to stay at home, and wear facial coverings, including bandanas, surgical masks, and respirators,

About the Governor & Executive Orders and this order was subsequently renewed by Executive Order 2020-022 and 2020-026, in further violation of the Bill of Rights, Amendments I, IV, VI, VIII,

Bill of Rights of the United States of America (1791)

Amendment I

Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the government for a redress of grievances: thereby, effectively depriving the People of New Mexico state of their “right of the people peaceably to assemble, Executive-order has limited public gatherings to 5 persons.

Amendment IV

The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no warrants shall issue, but upon probable cause, supported by oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized: thereby “seizing of the person” in their own home by the “Stay at Home” Executive Order.

Amendment VI

In all criminal prosecutions, the accused shall enjoy the right to a speedy and public trial, by an impartial jury of the state and district wherein the crime shall have been committed, which district shall have been previously ascertained by law, and to be informed of the nature and cause of the accusation; to be confronted with the witnesses against him; to have compulsory process for obtaining witnesses in his favor, and to have the assistance of counsel for his defense: thereby depriving the People of New Mexico to “enjoy the right to a speedy and public trial. The Executive Orders the law enforcement officials to issue citations in excessive amounts, and upon a second violation of failing to wear a facial covering in public, arrest and charge the “violator” with a fourth degree felony with no appeals process.

Amendment VIII

Excessive bail shall not be required, nor excessive fines imposed, nor cruel and unusual punishments inflicted: thereby inflicting a cruel and unusual punishment for being and staying healthy. Social isolation has been proven to be detrimental to the physical and emotional health of the People of New Mexico.

Violations of the Rome Statute of the International Criminal Court

Count I

1) Imprisonment or other severe deprivation of physical liberty in violation of fundamental rules of international law.

Count II

1) Torture as defined at Article 7, paragraph 2 (5): “Torture” means the intentional infliction of severe pain or suffering, whether physical or mental, upon a person in the custody or under the control of the accused; except that torture shall not include pain or suffering arising only from, inherent in or incidental to, lawful sanctions.

Count III

1) Article 7, subsection 11-Other inhumane acts of a similar character intentionally causing great suffering, or serious injury to body or to mental or physical health.

Count IV

1) For the purpose of this Statute, “crime of aggression” means the planning, preparation, initiation or execution, by a person in a position effectively to exercise control over or to direct the political or military action of a State, of an act of aggression which, by its character, gravity and scale, constitutes a manifest violation of the Charter of the United Nations.

Argument: Count I

Article 7, Crimes against Humanity, paragraph 1, (5); Imprisonment, Severe deprivation of physical liberty-Executive Orders mandating “Stay at Home” is a severe deprivation of physical liberty and the resulting imprisonment of the healthy population of New Mexico. There is a general fear and apprehension that any man, woman or child could simply be accosted, harrassed, interrogated and jailed by law enforcement officers for simply conducting their daily affairs.

Argument: Count II

Torture as defined at Article 7, paragraph 2 (5): the People of New Mexico are under the control of Governor Michelle Lujan-Grisham thru the State Police, City Police Departments and the County Sheriffs of New Mexico. The sanctions imposed by Executive-orders are not lawful, but rather de facto, as the legal system operates on a de facto basis, not a lawful basis. The legal system of the State of New Mexico operates under the “Color of Law”, not under the Law of the Land. In 1871 with the incorporation of the municipal corporation titled United States, the de jure states of the Union were converted into de facto, political subdivisions of the United States corporation.

Severe suffering, both physical or mental, has resulted from the deprivation of physical liberty, especially for the elderly who rely on familial relationships for comfort, safety and economic survival. “However, the most vulnerable are those with existing mental health issues like depression and older adults living in loneliness and isolation. Such people are self-judgemental, have extreme suicidal thoughts. Imposed isolation and quarantine disrupts normal social lives and created psychological fear and feeling like trapped, for an indefinite period of time. The looming economic crisis may create panic, mass unemployment, poverty and homelessness will possibly surge the suicide risk or drive an increase in the attempt to suicide rates in such patients.”

COVID 2019-Suicides: A global psychological pandemic

Humans are social beings interdependent for social comfort, safety, family gathering, graduations and a myriad of social events. The graduating classes of High Schoolers and University Graduates have been deprived of the social gatherings of their respective graduations and the public accolades that accompany their accomplishments. The basic social fabric has been torn violently and cast aside with no regard for the impact on the family system. Home violence has increased exponentially during the “Stay at Home” orders, a spike in suicide has resulted from sheer despair of not knowing how to pay bills or buy groceries for the children. Child rapes have increased. “There has been a rise in the number of minors contacting the National Sexual Assault Hotline to report abuse. That’s according to RAINN, the Rape, Abuse and Incest National Network, which runs the hotline. By the end of March, with much of the country under lockdown, there was a 22% increase in monthly calls from people younger than 18, and half of all incoming contacts were from minors. That’s a first in RAINN’s history, Camille Cooper, the organization’s vice president of public policy, tells NPR.”

Article 7, paragraph 1 (11): Other inhumane acts of a similar character intentionally causing great suffering, or serious injury to body or to mental or physical health. The forced wearing of facial covering, surgical masks and respirators of varying qualities, by Executive Order(s) will effectively result in massive, chronic, low grade infections by the end of the summer. Numerous studies have shown that the wearing of surgical masks and respirators for extended periods of time, results in hypoxia [oxygen deprivation] and hypercapnia [What is hypercapnia? Hypercapnia, or hypercarbia, is when you have too much carbon dioxide (CO2) in your bloodstream. It usually happens as a result of hypoventilation, or not being able to breathe properly and get oxygen into your lungs] The symptoms of hypoxia and hypercapnia range from mild to resulting in death.

The resulting symptoms and human devastation will be 100 fold more severe than those of the coronavirus.

Mild symptoms of hypercapnia include:

    • flushed skin
    • drowsiness or inability to focus
    • mild headaches
    • feeling disoriented or dizzy
    • feeling short of breath
    • being abnormally tired or exhausted

Severe hypercapnia can pose more of a threat. It can prevent you from breathing properly. Unlike with mild hypercapnia, your body can’t correct severe symptoms quickly. It can be extremely harmful or fatal if your respiratory system shuts down.

See your doctor right away if you have one or more of the following symptoms, especially if you’ve been diagnosed with chronic obstructive pulmonary disease (COPD):

    • unexplained feelings of confusion
    • abnormal feelings of paranoia or depression
    • abnormal muscle twitching
    • irregular heartbeat
    • hyperventilation
    • seizures
    • panic attack
    • passing out

Hypercapnia produces severe stress on the human body and can even result in death.

What are the symptoms of hypoxia? Although they can vary from person to person, the most common hypoxia symptoms are:

    • Changes in the color of your skin, ranging from blue to cherry red.
    • Confusion.
    • Cough.
    • Fast heart rate.
    • Rapid breathing.
    • Shortness of breath.
    • Slow heart rate.
    • Sweating.

Hypoxia also produces severe stress on the human body and can even result in death. Inability to focus, and confusion seem to be two common characteristics for both hypoxia and hypercapnia, which is perfect for the setup for a totalitarian state. Now if you dare to question the official narrative, monetary fines in an environment of poverty due to loss of jobs, and if you are recalcitrant, holiday accommodations in the local slammer, where you are guaranteed to be fourteen days for quarantine. It’s actually worse, if someone should get arrested for a second “facial covering” violation, now it is a fourth degree felony charge. There are no scientific, double-blind studies anywhere in the world that confirm a positive outcome to the wearing of surgical masks or respirators for extended periods of time. All such studies indicate severely detrimental outcomes for men, women and children of flesh and blood.

Conclusion

The level of human suffering from these above named violations has been astronomical and off the charts. It will forever change the very fabric of society in the State of New Mexico and around the world, and not in a positive direction. All of this could have been averted if political leaders had used real science instead of “prediction models” by various private organizations, including Event 201 was a 3.5-hour pandemic tabletop exercise that simulated a series of dramatic, scenario-based facilitated discussions, confronting difficult, true-to-life dilemmas associated with response to a hypothetical, but scientifically plausible, pandemic. 15 global business, government, and public health leaders were players in the simulation exercise that highlighted unresolved real-world policy and economic issues that could be solved with sufficient political will, financial investment, and attention now and in the future, by The Johns Hopkins Center for Health Security, World Economic Forum, and Bill & Melinda Gates Foundation. This was the model relied on by President Trump until the fallacy was shown clearly and all of their predictions were refuted by empirical science. By then the damage of the hysteria and fear was already done.

Relief Sought

It is imperative that the Executive Order(s) 2020-004, 2020-022, 2020-026, about-the-governor/executive-orders/ by Governor Michelle Lujan-Grisham be lifted immediately before they cause more severe and irreversible damage to the health and well being of New Mexican men, women and children of flesh and blood. Facial coverings must be made strictly voluntary, with no monetary fines nor jail or prison time. This Executive- Order was not based on proven science, but rather derived from a desire for unmitigated Power and politically motivated.
