On December 26, the body issued a favorable opinion on the government’s bill to transform the health pass into a vaccine pass. According to our information, and as also relayed by Alexis Poulin, editorialist at RT France, it turns out that the Permanent Commission of the Council of State held a meeting to vote on this measure… in a restricted formation.

Translation:

From the health pass to the vaccination pass, the Council of State is burying the State of rights, in a small vote in the restricted formation of the permanent commission, in all complaisance with an executive with a liberticidal project.

No, this is no longer democracy, it is a putsch.

The Conseil d’État does an about-face

After reversing its decision of July 2021, in which the highest administrative authority considered that the measure was justified to “limit the spread of the epidemic (…) and not by an objective that would consist in encouraging the persons concerned to be vaccinated”, the Council of State validated the bill on December 26, admitting that the incentive to vaccinate is indeed the goal of the executive.

The authority underlines in its opinion that the vaccine pass represents for the government a means “to encourage people who have not yet committed themselves to a vaccination plan to start this process”.

Translation: The Council of State forced to reverse its position of last July (left) and to validate today the fact that the vaccine pass is also – and perhaps especially – a means to encourage vaccination (right).

The Minister of Health, Olivier Véran, no longer makes a secret of the fact that the primary purpose of the vaccine pass is to twist the arm of people who are resistant to vaccination: “The vaccine pass is a disguised form of compulsory vaccination,” he told Brut on December 18. A speech that contrasts with his comments of August 7 to the Parisian. To the question “the extension of the pass, does it not amount to an obligation to vaccinate everyone?”, the minister replied: “No, it is an incentive to get vaccinated, to test themselves or not to go to places of strong gatherings.”

“A climate of forcing”, denounced Senator Alain Houpert

While the Permanent Commission was meeting in restricted formation, the decision to give a favorable opinion would have been played by one vote after a short debate. We contacted the senator of the Côte-d’Or, Alain Houpert (ER: Who is a medical doctor), who does not hide his amazement at this affair: “If this information is true, then the Council of State must question itself,” he said, adding that he hopes that all transparency will be made on the methods of this validation.

He deplores “a climate of forcing” and an instrumentalization of institutions that are supposed to “serve the people and not the power”. In this sense, the senator recalls the thought expressed by Jean-Etienne-Marie Portalis in his speech presenting the Civil Code delivered in 1801: “Good civil laws are the greatest good that men can give and receive; they are the guarantee of all public and particular peace.”

In addition, Mr. Houpert also denounced on Twitter a “burial on the sly, in the secrecy of the salons of the Royal Palace … since our freedoms are now the Prince’s doing!”

For its part, the Council of State justifies its support for the vaccine pass by the fact that “in view of the evolution of the epidemic situation and the progression of vaccination coverage in the country, this indirect objective of the measure […] is in line with the constitutional objective of health protection”.

A January 15 implementation date

This controversial bill was then adopted by the Council of Ministers the following day. “This means that in places where this pass has been in force for several months, restaurants, bars, museums, theaters, media libraries, seminars and fairs, sports halls, sports and entertainment venues, it will be necessary to justify being vaccinated to enter,” explained the Prime Minister. “The production of a test will no longer be enough. This new rule, if it is voted by the Parliament, will apply from next January 15”, announced Jean Castex.

The text will be examined in committee at the National Assembly from December 29, before going to the Senate from January 5.
