Former DOJ Attorney Finds Glaring Flaw in Trump Indictment

A former top Justice Department official believes he has found something in the indictment of Donald Trump that could actually lead to a dismissal by a federal judge.

Jeffrey Clark, who served as an assistant attorney general in the Trump administration, said on Friday after reading through the 49-page indictment that there is something on page three that is troubling for the prosecution.

“I’m beginning to read the indictment against Trump,” Clark said. “But even three pages in, it’s clear that the leaks that preceded the indictment are far too close to what is actually being pleaded by DOJ to be a coincidence.”

“For example, in paragraph 6a on page 3, we hear about the recording of the Bedminster call, which the MSNBC’s of the world have been beating a dead horse about for quite a while based on such leaks,” he continued. “This means that Trump lawyers could not possibly be the source of the leaks. Ergo, the leaks are coming from DOJ. They must be investigated and punished.”

“Also, this is grounds for granting a motion highlighting jury pool poisoning and dismissing the indictment before it reaches even its one-month birthday,” he added. “All of this is so outrageous; it shocks the conscience. It’s fundamentally anti-American. Trump Witch Hunt Number … what? I’ve lost count. Let’s call it Trump Witch Hunt #99.”

Special Counsel Jack Smith has charged the former president with 37 counts related to the handling of classified documents. If convicted on all counts, Trump, who is seen as a major contender against President Joe Biden in the upcoming presidential election, could face decades in prison.

Trump recently announced that he has been indicted by the U.S. Department of Justice on charges related to his handling of classified materials found at his Mar-a-Lago estate in Florida last August. The charges include offenses such as the willful retention of national defense information, conspiracy to obstruct justice, withholding and concealing documents, and making false statements. While the maximum sentences for these charges range from five to 20 years, any eventual sentence upon conviction would likely be lower.

According to the indictment, Trump allegedly disclosed classified documents to individuals who lacked proper security clearances on two separate occasions. The Department of Justice (DOJ) asserts that both instances occurred at Trump’s golf club in Bedminster, New Jersey.

Details regarding one of the alleged instances were leaked to CNN, which reported on June 2 that federal prosecutors had obtained an audio recording of a summer 2021 meeting in which Trump acknowledged holding onto a classified Pentagon document concerning a potential attack on Iran. The leak, however, did not disclose its source.

Political and legal analysts provided further reaction to the Trump indictment.

“The most ‘damning’ allegations in the Trump indictment are that: 1) He stored classified info in unsecured locations, and continued to move boxes after investigation commenced; 2) He showed a reporter documents that he purported were classified while seemingly acknowledging he could no longer declassify it; and 3) According to attorney notes, he made a “plucking” noise suggesting his team should remove documents that he perhaps thought were incriminating,” attorney Viva Frei remarked. “The ambiguity in these allegations, and the omissions from this indictment are remarkable. And the willingness of people to now faithfully believe the same institutions who have lied about everything from spying on Trump to Russia-gate to the Steele Dossier to Impeachment to Hunter’s laptop to January 6… Wilful TDS partisan blindness.”

“First read of indictment and my reaction is ‘That’s it?’ The conspiracy is with the aide who moved the boxes?” radio host Hugh Hewitt said. “No documents were sold or given to third parties not in his close employ?”

“[N]o one outside of DOJ has seen alleged ‘classified documents.’ In special master case, Trump’s lawyers repeatedly complained they did not have access to the documents,” American Greatness’ Julie Kelly commented. “That, of course, will not continue as MAL case progresses. As I’ve said—no reason to trust this indictment.”

Images from the boxes alleged to be found at Mar-a-Lago have surfaced online.

The boxes were stacked neatly in some photos and the contents were not readily apparent to the public.

There were other photos, however, that looked more staged. Old newspapers could be seen littered on the ground.

This isn’t the first time the public has seen such splays of documents. After the FBI raid last September, photos appeared of purportedly “classified” documents.

Biden, of course, famously had “classified” documents stored in the back of his garage behind his Corvette.

New Hampshire Gov. Chris Sununu appeared on CNN and pointed out the absurd legal double standard.

“They saw boxes behind Biden’s corvette. And the average American is going, what’s the difference?” Sununu said.

That’s the million-dollar question on everyone’s minds as the nation heads closer to the 2024 election.

  1. Don’t know if trump did anything wrong, but if so it cannot compare to the traitorous acts of biden and his anti-law, anti-American, anti-family admin.

  2. Here’s the thing, considering the necessities of Trump’s presidential campaign, together with his pugilistic nature, would he agree to a dismissal on those grounds? It would be kin to Rachel Maddow’s ludicrous suggestion that Trump would accept a dismissal of all federal charges if he agrees not to run for reelection.
